If the other driver’s insurer declares that you take payment from your own insurer because they can’t prove that their policyholder is at fault, you might want to hold off from fighting them. The best thing to do is to weigh your options first. If you file a claim with your insurer, they might be the ones to fight the other insurer if they find out that you are not the one at fault. Sometimes, even if the other driver admits to his fault and the police report agrees, his insurer will take his side of the story he made when he reported to them just to steer clear of paying your claim.   1. Ask Your Insurer if Nothing Works 

Even if it’s not your fault, you can contact your insurance company and make a claim to cover the damages and injuries you had.
